| Duties and Responsibilities | |
| Objectives of the assignment: The objective of this assignment is to develop a proposal for comprehensive generic policies focusing on the safety of journalists as well as draft amendments to defamation laws notably to include anti-SLAPP provisions. The objective is also to develop a methodology on how to collect data in relation to SDG indicator 16.10.1 on attacks against journalists, human rights defenders and trade unionists. This work would contribute to the development of a comprehensive framework that can support media organizations to enhance the safety and well-being of their journalists. Job content: The consultant will be responsible for drafting a proposal for generic rules and procedures to address safety concerns and establish an effective internal mechanism that can be put in place by media outlets. The consultant will produce a proposal for draft amendments to defamation laws to prevent the filing of SLAPP lawsuits. He / She will also develop a methodology for competent institutions on how to collect the data for SDG indicator 16.10.1. The consultant will deliver policy proposals aligned with the highest international standards and practices, in a comprehensive format, and with explanatory notes. These documents will be designed to facilitate effective utilization in future technical advice and advocacy efforts. In the conduct of this work, the consultant will consult journalists, media organizations, journalists’ associations, parliamentarians, lawyers, and other relevant stakeholders. Expected results: Under the supervision of the Senior Human Rights Adviser within the Office of the United Nations Resident Coordinator in Bosnia and Herzegovina, the consultant is expected to deliver the following products: The consultant will be responsible to prepare the following products within the following deadlines: Desk research, consultations (11 September 2023)Draft policies and methodology (28 September 2023)Incorporation of comments and production of a final product (16 October 2023). |

| Education: Advanced degree in Media, Social, Political Science, Law or other relevant field.Bachelor’s degree with additional two years of relevant working experience will be given due consideration in lieu of Master’s degree.
Experience:Minimum of seven years (with Master’s degree) or nine years (with Bachelor’s degree) of working experience related to media ;Proven experience in conducting in-depth analysis and producing quality and concise analytical reports, including on media freedom;Solid knowledge of international human rights norms and standards, and proven experience in applying media law and human rights standards and principles to research and analysis;Excellent knowledge of the media legislation and landscape in the country, including experience in working with media organizations. Languages:Fluency in oral and written B/C/S and English. In 2022, within the framework of the Global Drive project for Media Freedom, Access to Information and the Safety of Journalists[1] – a global project funded by the Netherlands and implemented by the Office of the United Nations High Commissioner for Human Rights (OHCHR) and the United Nations Educational, Scientific and Cultural Organization (UNESCO) – OHCHR and the United Nations in Bosnia and Herzegovina published a Report on the safety of journalists and access to information in Bosnia and Herzegovina.[2]
The report highlighted various challenges faced by journalists and other media workers in Bosnia and Herzegovina to safely and freely exercise their profession, and put forward recommendations to improve the legal and policy frameworks, as well as for protective measures and institutional responses to prevent and address violations of freedom of expression and access to information for journalists. A main finding of the report is that Bosnia and Herzegovina does not have any specific legal and institutional mechanism dedicated to the protection of journalists. In 2019, in the context of its third Universal Periodic Review (UPR), Bosnia and Herzegovina received recommendations to take all the necessary measures to guarantee full respect for the rights to freedoms of expression, peaceful assembly and association, in line with the International Covenant on Civil and Political Rights, including to ensure a safe and enabling environment for human rights defenders, activists and journalists, and that any attack against them or members of their families be properly investigated and the perpetrators brought to justice. The project will contribute to support implementation of these UPR recommendations. The project will also contribute to the implementation of Sustainable Development Goal 16 (to promote just, peaceful and inclusive societies), target 10 (to ensure public access to information and protect fundamental freedoms, in accordance with national legislation and international agreements), indicator 1 (related to the safety of journalists, trade unionists and human rights advocates).
The purpose of this consultancy is to support implementation of some of the recommendations made in the above-mentioned report, and specifically to draft proposals for specific, comprehensive policies that can contribute to strengthening the safety of journalists and other media workers. The work will be conducted in consultation with media professionals and other relevant actors, including the national human rights institution.
The proposals will pay due attention to gender dimensions. The policy proposals produced through the consultancy would be conceived as reference technical documents for the United Nations in Bosnia and Herzegovina, journalists, media organizations, associations of journalists, parliamentarians and other actors to undertake advocacy actions aimed at strengthening the safety of journalists through legislative provisions / changes and institutional protection. The project will support implementation, in Bosnia and Herzegovina, of the United Nations Plan of Action on the Safety of Journalists. Launched by the United Nations Secretary-General in 2013, this plan aims at fostering a free and safe environment for journalists and media workers. It calls for a coalition-based and holistic approach and includes six areas: awareness raising, standard setting and policy making, monitoring and reporting, capacity building, and research. The proposed project will contribute to awareness raising, standard setting, policy making, capacity building and research.
